‘Transilience’ – Joelle Ruby Ryan University of New Hampshire Harassment Campaign Against Women : Call For Action

March 11, 2013

university of new hampshire health joelle ruby ryan

I am writing this today out of a deep concern for the rights of women, feminists and lesbians to speak publicly about issues that effect us. Specifically, I would like to address the actions of Dr. Joelle Ruby Ryan and his ongoing attempts to harass, bully, censor and silence women and feminists on the internet, and the University of New Hampshire’s apparent complicity in his outrageous and illegal actions which Ryan claims to perform under authority of UNH.

You may notice that this week’s post -where we discussed ‘Transilience’, Joelle Ruby Ryan’s new University of New Hampshire Health sponsored video- is no longer visible. Also missing are your comments in the discussion that followed. The reason for this is that UNH’s Dr. Ryan has filed a false, perjured, harassing copyright claim that he apparently hopes will re-write all previous first amendment rights. Here is a screen cap of the post in question:

what it looks like when WordPress.com hides your post

Here is the entire text of that post, none of which Dr. Ryan had a problem with. It was succinctly titled “Transilience – Hilar!” and read:

Joelle Ruby Ryan’s new autobiographical spoken word/stand-up routine.

Joe is the guy who teaches Women’s Studies at the University of New Hampshire who claims the word “female” is outdated and offensive, that there is no shared experience of oppression among women, and thus no class basis for a feminist movement. Joelle believes all female gatherings and spaces should be outlawed as discriminatory against males. More about Joe here:https://gendertrender.wordpress.com/?s=joelle+ruby+ryan

In this looong monologue, the 6 foot 6, 350 lb Ryan shares his youthful experiences being called a “fag” which somehow translates into discovering the sexxay of pantyhose on his shaved legs and a love of stilettos. He shares tales of blowing chunks of sushi all over during drunken binges, and reveals the peace he achieves taking long 4am walks around town alone.

Excerpt: “Mother Nature is a great teacher. I am continually amazed at the kindness and cruelty of the natural world. And by the breadth of diversity to be found within it. When I gaze at flowers I see so many different colors. When I look at trees I see so many different leaves and barks. When I look at stones, I see many different shapes and sizes. Some smooth, some rough. At the ocean, I marvel at the teeming life to be found in it’s depths. Each individual creature so unique, diverse, and crucial, to the well-being of the whole eco-system. Human beings come in many different colors, shapes, and sizes too. They also come in many different sexes, genders, and sexualities. And yet, the very vibrant diversity we can see so easily in the natural world, becomes much harder to see when it comes to human gender. Black or white. Either/Or. One or the other. Why can’t we transpose the brilliant hues we see in flowers to the myriad of genders we know exists in humans? I am an audacious orange flower blooming in the sun and delighting in the soft summer rain. I am also a person who demands the right to be ambiguous, fluid, and defiantly, boldly, queer. I almost never for instance wear breast prostheses. And while I wholeheartedly support the choice to do so, made by many of my sisters, I do not wish to wear silicone mounds on my chest to make others feel more comfortable.”

FORTY MINUTES of this, folks! ENJOY!

You will immediately note a few things.

Joelle Ruby Ryan identifies himself as University of New Hampshire representative

  1. Joelle Ruby Ryan identifies himself as a designated representative of the University of New Hampshire who is acting on authority of that institution.
  2. Ryan claims that using the “embed” function on YouTube videos is a form of copyright infringement. That is simply false. Not only false, but absurd. When University of New Hampshire Health (or anyone else) posts an embeddable public video: anyone, anywhere can embed that video on any site for any reason. You can read about that in an article titled “Court Rules That Embedding A Video Isn’t Copyright Violation” here: http://www.geekosystem.com/embedding-video-copyright-infringement/
  3. Dr. Ryan also claims that a still image from a public video, used for purposes of critique and discussion of that public media, is a form of copyright infringement. Again, an absurd claim that runs in opposition to all known First Amendment law. You can read about that here: http://en.wikipedia.org/wiki/Fair_use

You can also read YouTube’s standard terms of service which state:

Section 6 (C)

6. Your Content and Conduct

You also hereby grant each user of the Service a non-exclusive license to access your Content through the Service, and to use, reproduce, distribute, display and perform such Content as permitted through the functionality of the Service and under these Terms of Service.

————————————————————————————

I know, I know. You’re thinking “even a twelve year old knows these things Gallus”. And I agree. They do. We all do. We don’t need a PHD to know that folks- even those we disagree with- are allowed to post about and discuss public media campaigns issued by University of New Hampshire Health, or any other entity. Even your uncle sam’s wedding video could end up “going viral” once he authorizes it’s publication- it happens all the time. Free Speech!

So why is a self-declared agent of the University of New Hampshire filing perjurous, false, ABSURD legal documents against a small Lesbian Feminist blog?

The only conclusion I can reach is that Dr. Joelle Ruby Ryan may be falsely representing himself as an agent of the University of New Hampshire. I reach this conclusion because I think UNH attorneys would not authorize false and frivilous, perjurous claims against Lesbian Feminist bloggers. They might, wisely, consider such actions a form of stalking and harassment- actions which the University of New Hampshire may well be liable for.

I look forward to the impending legal proceedings which were initiated by an agent of the University of New Hampshire on the basis of their claim that posting a YouTube video on a blog is an actionable copyright infringement. I also look forward to the upcoming legal proceedings initiated by the University of New Hampshire against a Lesbian feminist blogger for publishing a still from a UNH Health video for purposes of critique and discussion.

When a publicly funded university mounts such an incredible First Amendment challenge to the rights of bloggers to embed, screen-cap, write about, discuss, and critique the media campaigns published by them one can only wonder in awe which of the University of New Hampshire attorneys authorized such an action. This promises to be a fascinating – even surreal- legal exercise. One which I suspect will not end in favor of the civil liberties restrictions being litigated by the University of New Hampshire and it’s agents.

In the meantime, while the attorneys do their work, I would like to ask for your help.

I would like your help in celebrating our most basic first amendment rights: as bloggers, as women, as feminists and feminist allies, as lesbians and as gays.

I call on you to protest the University of New Hampshire sanctioned harassment of GenderTrender and all other feminist, lesbian, and gender critical bloggers and blog readers by making a post that includes either the video ‘Transilience’ or a screencap of such.

That’s right!

Feel free to copy and paste this post on your own blog or tumblr blog. Feel free to make your own post sharing your thoughts and impressions of Joelle Ruby Ryan’s UNH Health video. Feel free to create amusing and charming memes featuring these materials. The key words here are “Feel Free”. Because it is legal, it is our right to do so, it is protected speech (University of New Hampshire claims notwithstanding). Let’s enjoy and EXERCISE our free speech rights as Feminists and Women and say NO to infringements of our civil liberties.

Thank you for your support.

OMG this is priceless. I think maybe for the next trans day of remembrance it would be nice to have something to commemorate the women killed by trans and the victims of rape/violence–it might take two or three days.

It’s 40 minutes of “here are all the mean things people have said/done to me over 40 years”. If women tallied up their individual oppressions and made videos, they’d go on for weeks.
This is ridic, and reeks of male privilege with some AGP thrown in for good measure. You got turned down twice to change your name? Least you got to plead your case to a judge. My cases, a rape case and a childhood sexual abuse case, didn’t even get close to that far. But no, you’re right, poor you.

It’s like those academic dolts in the Joy Ladin protest letter who described writing about domestic violence against women as banal. Misogyny against us is normal; it’s only noteworthy when it happens to a male. Ryan thinks there is no female sex class, so the fact that we are socialized from birth by constant reinforcement of our status not to be as outraged over every slight as he is escapes him.

This guy just won’t quit! This ‘performance’ (?) as well as a full-length autobiographical video, and a book of the worst poetry on earth. And I bet he isn’t even finished. I wonder what makes him think his life is of interest to anyone? (Except, perhaps, other autogynphiliacs, who want to hear all about ‘soft nylons on shaved legs’ etc. ad pukeum.)

Thanks for another wonderful post Gallus! Please don’t think I’m trying to derail the discussion, but I had an encounter recently with a transwoman on a funfem site and the idiocy has left me astounded. Much like Joe believes that everyone wants to hear his opinion on everything (now in a new authentic female voice!), so do most transwomen on the internet. This came from an article on why men like to create fake profiles on lesbian dating sites:
Transwoman:As a transwoman who is primarily interested in women, where the hell do I go on the internet? Not all of my relationships with straight identifying women have ended badly, but I have had quite a few who get into a sexual relationship with me and after a few months look at me and say, “Wow, you really ARE a woman. I’m not a lesbian. This isn’t going to work.” And it has little to do with my plumbing.
Me:Sorry, you’re not a real woman, as in a biological female. Why do transwomen have such a hard time realizing that lesbians do not want someone with a penis?
A neovagina isn’t the equivalent of a real vagina either. One is a constructed fuckhole built by the medical establishment, the other is an actual organ that’s part of an organ system.
You’re whole comment is rife with male entitlement-no one is entitled to get sex from anyone.
(After comments from others about how I have to read a book, check my privilege, stop trans-shaming, repeated shouts of transwomen are women!!, etc)Transwoman:You have my gratitude for this. You really do, because even with a well adjusted sense of self, comments like this DO hurt. This individual is a known trans exclusionary radical feminist. I simply pressed dismiss, because it’s not worth it. This person is not ignorant or uneducated. This person is a troll. Arguing with this individual, or those like this individual, will stifle the discourse rather than help promote it.
“Don’t wrestle in the mud with pigs, you get all dirty, and the pigs like it.”
But again, my gratitude is genuine, and I wish they’d fix private messages so I could have just sent this to you directly instead of possibly providing bait.
Me: What the hell are you talking about? I’m not a “known trans exclusionary radical feminist.” I barely have any internet presence at all-I only made a few comments in the past week or so when I started reading the site.
How am I stifling discourse again? I don’t recall making death threats, deleting anyone’s comments,. etc.
In response to the other comments on “cis-privilege”- Women have never had any privileges that came from being female. None whatsoever. Women’s experiences are unique in that, even though transpeople face the threat of rape too, women are the only ones who can get pregnant from it. You’re really lucky that one of the worst things to happen to you is someone “disrespecting your gender identity” considering that women have our humanity denied everyday.
I believe trans people should have the same rights as anyone else, but I’ll continue to
save my sympathy for born females over female impersonators.
Oh and btw- just because you keep saying “transwomen are women!!!!1!!” doesn’t make it true.

After a while all I saw was “WAAAAAH I was excluded from something on the internet! Why doesn;t anyone respect my jenda identity!!!”
Thanks for letting me get that off my chest! X

I think trees are EITHER oaks OR elms or maples, etc. And I don’t think anything in nature voluntarily alters the ways its sex is perceived by others. Also somehow I don’t think any real woman would feel especially safe wandering the streets at 4 am, especially one like me who is a foot shorter and nearly 200 pounds lighter than ‘Joe.’

Oh what a surprise, I got a response back from the poor oppressed transwoman saying that he wishes I would stop being so hateful, that we should be allies b/c we’re both oppressed by men, that how dare I decide who is a woman and who isn’t (because some women can’t get pregnant blah blah blah), and of course the whole “I’m going to be the better person and not engage with you anymore.”
Aaaaand I’ve reached peak trans. After watching this video, and reading the comments from Oppression Olympics trannies, I’m done “engaging” with them. And I hope the fun fems have a blast sucking their collective dicks.

Since this dude imagines females are outdated, one can only wonder where he imagines he comes from. I know! He must’ve been made in a test tube marked “Failure!”

I would be much more prepared to hear all these guys claims to femaleness if they didn’t AT FIRST lay claim to womens studies or dyke fests and female power things like that. If they were blokes that were against other blokes and identified with females against oppression I would give them more than the time of day. They are obviously men when they want to attack female spaces. They list attacks against trans-want to be females -but males from other males. Their answer??? Take over women studies???????? wierdoes

Listening to what he said: ‘Transilience’ is gob shite. He is an non-intellectual, unattractive and weak power man who is now allowed to claim power (people listening, being head of academic studies!!!!) from claiming trans ‘identity’. No thought to the millions of women (some of whome have their genitals cut off) he is now replacing. Because he listened to a gay man sing??? ” Do you really want to hurt me”??? He should listen to that every time he acts as male overlord to women studies.

This would be hysterically funny if it wasn’t for the power this prick has. Yes, Lucky’s right about his teaching “women’s studies.” It is so outrageous and insulting to women. Too bad this fucker didn’t just emulate Boy George and be a transvestite. But then he wouldn’t have anywhere near the power he has when pretending to be a woman. How can any woman support this prick?

I’ve decided to coin a new word after watching all of this I could stand. Transillyness. Transillyness is kinda of related to female impersonation and male impersonation but it is different in that it is about injecting lame humor while impersonating a transistioned person on 24/7 basis without realizing that is what your doing. Could also work as a good definition for Autogynephilia and transgender.

The DMCA is a bad law that is prone to abuse. It doesn’t have any real penalties for mistakes, or taking down content that shouldn’t be.

It does, however, have one rather strong provision to prevent some forms of abuse. In particular, it requires one to testify – under penalty of perjury – that one is authorized to speak on behalf of the copyright holder in question. If Joelle doesn’t have that authorization, well, that’s perjury.

The internet is a valuable resource for promoting democracy in an often undemocratic world; a safe space for women and the otherwise oppressed and a vehicle for their otherwise-unheard true voices. Resist attempts to close down those spaces and muffle those voices.

To paraphrase an oft-quoted Martin Niemoller:
‘First they came for the women, and I didn’t speak out because I wasn’t a woman…’
Joelle Ruby Ryan presumes to speak for women, with the full backing of the law and the blessing of the intelligentsia. ‘Hers’ is the voice of bigotry, not Radfems such as GallusMag. Embrace the opportunity for dissent; it’s too easy not to…

How ironic that Joe lives and works in a State that has as its motto “Live Free or Die”- apparently he feels that it is interpreted as “live free” so long as Joe approves…

The other issue that I see the university getting involved with is whether the material is truly copyrighted BY the university. After all, if it is a university production, then Joe already consented to his use in the video and the entity that would have the right to raise any potential copyright issues would be the producer, not the actor. Last I checked, most universities do not host their Womens Studies programs under the Health Department, and presuming that to be true with UNH, Joe is now on record as having overstepped his authority…wonder if that could get the school’s attention to terminate whatever contract he has with them.

    • GallusMag Says:

Joe may possibly have impulse control problems. He gets himself banned from the Women’s Studies lists for attacking actual women until the mods send all his comments straight to spam. Then he wonders what happened.

Would not surprise me ONE BIT to find that Joe was not in fact authorized to champion new restrictions on YouTube videos on behalf of the University of New Hampshire, and was just a biggo rage machine going off HALF-COCKED. (Or fully cocked in his case *snicker)

What is Ryans salary–as a state school that should be public. I can’t find any “academic publications” that Ryan has done. I wonder about that

      • I was wondering that too- I’ve a hard time thinking of a professor as “economically challenged.” From what I can find, average salary for a full professor at UNH is $114k/yr, associate professor $88k/yr, and lecturer $54k/yr.

      • Motherhood Says:

It should be listed someplace becasue it is a state school. I am betting maybe 40K and health insurance, Tops 60K. Ryan has no publications, no research and is an idiot. An adjunct would get maybe $ 3000 (yes 3 thousand a course) a lecturer more but not the same as a tenure track. If Ryan is making anything near 88K then I would say every woman in that department who has published and done research has a lawsuit. The economic “challenge” maybe the result of the cost of looking that good all the time.

      • magicpoppy Says:

        Ryan is listed as “lecturer”:

        http://www.unh.edu/womens-studies/index.cfm?ID=784B61C4-0759-8EAC-C57E0FE9E9C20E73#ryan

From an article written for a conference:

        http://ai.eecs.umich.edu/people/conway/TS/IFGE2009/Joelle/The_Transgender_Tipping_Point.html

I would like to also note that I hail from a working-class family and that I am a first-generation college student. Dreger’s admonition that I am not acting like a scholar reeks, in my opinion, of classism, elitism and academic snobbery. It is people like her that give academia such a bad name.

Ryan claims to have received a day scholarship to Phillips Exeter, the posh prep school attended by Gore Vidal and Mark Zuckerberg. Had I an Exeter diploma, two MAs and a PhD (in American Culture Studies, big whoop), I hope I’d be a better writer than Ryan.

        From the footnotes:

Cisgender, or its synonym cissexual, is a word developed by transsexual man Carl Buijs in 1995 to refer to non-transgendered people. The word uses the trans-cis distinction in discussions of molecules in Chemistry to reference those who cross and those who stay on the same side, respectively. Although non-trans is still an acceptable term, cisgender has become preferable to words like genetic, biological or natal people.

Preferable to whom, Joelle? Citation needed.

I’ve only recent started reading radfem blogs, but have already had run-ins with a couple of males. They are so quick to take offense, but obviously don’t know what actual oppression is. One guy, who calls himself Savannah, says he was sexually harassed by a woman, but wouldn’t say how. Somehow I didn’t believe him.🙂

One option for dealing with bad DMCA takedown notices is to send a counter-notice:

    http://en.support.wordpress.com/content-theft-what-to-do/

“If the owner does believe that he or she has the legal right to distribute or publish the reported materials (and that they were wrongly removed), a DMCA counter-notice may be filed. Unless you bring a lawsuit within 14 days, the host or service provider is required to reactivate the material.”

    • GallusMag Says:

Kathrin! Where the fuck have you been? Hope you are well.

      • Kathrin Says:

I’ve been doing pretty well, actually.

One of the commenters on the site had expressed that I was not welcome here, so I stayed away. I don’t wish to impose on others where I’m not welcome. That’s a lot of what irks me about the TG activists. The comment made it through moderation (though I believe it was later deleted), so I didn’t know if that was your policy as well.

I commented because The DMCA takedown is unpardonable, and content providers (like WordPress) don’t always do a job of letting people know they can send counter-notices to force the ISP to put the content back. Speaking up (especially in a case like this) seemed the right thing to do.

This is yet another case of “trying to shut women up by whatever means are available”.

      • GallusMag Says:

I vaguely remember that. I took down that whole fight because it seemed arbitrary and boring for readers. I do occasionally remove things that may bore readers – or that post information I don’t want to share with men that hate us. 😉
btw I always enjoyed your comments- I had nothing to do with that fight.

  11. GallusMag Says:

He is out of his fricken mind. I bet the locals are terrified of him. Huge guy plodding around town at 4 am muttering under his breath about how females are obsolete and offend him.

  12. Em Says:

Our big mistake was to snicker and complain. (You know how fish does!) If we’d gone on and on about the bravery of such a one, to undertake and never waver from this miraculous journey, all would have been well.

  13. Motherhood Says:

Okay this might not be news to anyone but Ryan is a lecturer–that is not a tenured position. It does not even mean “tenure track” in most cases–it is like an adjunct. I wish that somehow the defamation could be adressed directly to UNH. Does anyone think it can and how.

    • BadDyke Says:

“Okay this might not be news to anyone but Ryan is a lecturer–that is not a tenured position.”

Yes, the DIFFERENCE between the US and the UK often causes confusion. So, over here lecturer IS staff (as opposed to contract research, say, as we don’t really have tenure anymore), whereas we think that in the US everyone who is anyone gets called a professor of some sort (associate/assistant/affiliate/whatever as long as it begins with ‘a’ or so it seems!). So, someone being called lecturer in the US looks like — we employ them to do the boring stuff that we can’t be bothered to do (i.e. some really tedious lecture courses to first years), but that’s it, they’re not involved in our research or any proper stuff…………

Joelle looks like a Kids In the Hall sketch !

  15. KittyBarber Says:

Seems that Joe is not quite so ‘transilient’ after all: he’s got his boys out there combing the Amazon reviews for Bad Things Lesbians Say.
    Here: http://www.amazon.com/review/R25QG7PG8P4WN8/ref=cm_aya_cmt?ie=UTF8&ASIN=1420869299#wasThisHelpful

    • Ashland Avenue Says:

Wait…did Joe actually review his own fucking book?! Why yes, he did. Gave it five stars, natch! Said it before, and I know I’ll say it again: un-fuckin’-beLIEVable.

  16. Abi Says:

why is’nt “cis” speech, hate speech??? These lunatic men are redefining women, and shouting about inclusion where for the most part in the world females are used as breeding slaves.

There is an adult female going for the presidency of Afghanistan but these type don’t want to bother those male reactionaries ‘over there’. The just LOVE the Western Universities, where they can bother and make feel guilty Western females. I’ve seen enough of this trans ideology to leave me sleepless. It makes me worry for every female I am responsible for. These men (who covet female-ness) need to take a long hard look at themselves in the mirror (and I don’t mean at their hair or make-up).

If a trans- male to female went to Afghanistan and tried to protect females in that country, I would, personally give him a pass. Rather than take over womens studies at the University of New Hampshire???

  17. Abi Says:

He’s a nice guy, seems to be. But seems to me to have an Oedipal complex…. BTW Do women wave their hands a lot? Do females put their hands behind their backs when they are speaking out? To him they do?

I personally know of a grandpa whose sold his house to get CANCER treatment in the U.K…obviously his male to femaleness “feelings” are more important than that.

  18. […] academia can be. Academia has given us Catherine Hakim, Satoshi Kanazawa, Steven Landsburg, Joelle Ruby Ryan, Laura Agustín (to name but a few), and, of course, Hugo […]

  19. Lemoni Says:

after getting Lierre Keith removed a speaker this guy is flaunting popularity as a gender lecturer and wants people to fund him to hear his acid fuelled logic

    • Ashland Avenue Says:

I had to laugh at the gigantic picture of himself that Joe Ryan just had to add to that site, Lemoni. Sez Joe: Must…have…more…pictures….of me….online……..MOAR PICTURES!! BIGGER PICTURES!!

      • GallusMag Says:

He has a showing of Transilience that females are restricted from attending at The upcoming Phila Trans Health Conference. Males Only!

      • Ashland Avenue Says:

Then I guess we need to set up a camp in protest!

      • Ashland Avenue Says:

Ha! This may make you think less of me, Gallus, but I’ll have to pass. Simply because Joe Ryan is not worth the money it’d cost me to get to Philly, plus a hotel room, even for just a night. Too much dough involved over a man I couldn’t care less about.

      • michelle Says:

sadly I would have to agree that Joe isn’t worth the expense involved in getting to Philly even though I could do it all on points/miles…

But it would have been fun- we could have all donned sheets like the one in Washington or whereever that was with the drawing that inquired “does this dick make my rights look bigger?”

      • Couldn’t he have run a brush through that hair?

  20. You people are utterly vile. I know Joelle and she is a kind, competent person. How dare you spew such hate and intolerance against another person. There is a higher justice to which you will someday be accountable.

    • GallusMag Says:

You’re an anti-abortion activist? The higher justice is Jesus, am I right?

    • GallusMag Says:

Does Joe share your views on abortion?

    • Ashland Avenue Says:

Proudly displayed in Meghan the anti-choice activist’s list of “likes” is: The Cheesecake Factory.

      THE CHEESECAKE FACTORY.

      THE CHEESECAKE FACTORY.

      Your argument is invalid.

    • liberalsareinsane Says:

You know what’s vile? Silly little girls who admire grown ass MEN who kick women in the face. That dude Fallon Fox as a “favorite athlete”? Do you write love letters to prisoners as well?

      • anon male Says:

What makes it even more bizarre is that it’s evident she doesn’t care about sports one way or another (nothing wrong with that!), doesn’t give a damn about women’s sports in specific, nor does she have an interest in martial arts, but the fact that some tranny, somewhere, is doing something — anything — and suddenly she has to rush over and like them on facebook to show her solidarity. That’s what “activism” has come to? And what other demographic gains cheering sections so easily?

If Joe Ryan is anti-choice, I suspect it’ll hurt his career in telling women what to do even less than it hurt Hugo Schwyzer’s.

      • Ashland Avenue Says:

Well, it seems Meghan the Anti-Choice Activist is upset that we actually looked at her Facebook page (the Facebook page that MEGHAN HERSELF linked to – it sure as hell wasn’t any one of us), ’cause it’s “unavailable” now. Pity. I wanted to go back and count the number of hard-luck cases she aligned herself with in order to be Da Best Soshul Justis Warrior of Dem ALL!

Unless the hard-luck case happens to be a born female. Then it’s a no-go. Boundaries, people.

  21. farishcunning Says:

“a higher justice”? Are you kidding? If there were any justice at all, misogynistic males like Joe Ryan wouldn’t be teaching WOMEN’S Studies.
