On Friday, the Trump administration issued changes to controversial Obama-era guidance on placement of transgender prisoners.  Previous guidance prioritized the sexual rights of male offenders, allowing them to “identify as” female and be transferred to the female division, eliminating women’s longstanding international human rights to be incarcerated separately from males.

The new changes reestablish the sex-based rights of female prisoners to be housed in separate accommodations from males when confined by the state. Women’s basic rights to privacy from male inmates in vulnerable conditions of incarceration including sleeping, showering, and toileting were also acknowledged.

The Female Offender Branch of the Federal Bureau of Prisons, which is tasked with implementing transgender policies, was re-named the “Women and Special Populations Branch”.

The agency will now use biological sex, not an inmate’s declared gender feelings, as the initial determination for placement of individuals who identify as transgender. Transgender inmates may still be transferred to opposite sex facilities under certain conditions, namely after significant medical and mental health “treatment”.  From the new guidance:

“The designation to a facility of the inmate’s identified gender would be appropriate only in rare

cases after consideration of all of the above factors and where there has been significant progress

towards transition as demonstrated by medical and mental health history.”

The policy changes were first reported by Buzzfeed, which ran the headline: ‘The Trump Admin Just Rolled Back Protections For Transgender Prisoners’

Of course, this isn’t true. For women who identify as transgender (“transmen”) the Obama era guidance did not protect them. It put them at great risk as females potentially transferred to male prisons. There are ZERO transgender people born FEMALE who were “protected” by the Obama era guidance. ZERO.

But much like the Obama administration, the boys at Buzzfeed completely disregard the welfare, rights, and safety of the female half of the human population, including those who identify as transgender.

You can see this male bias in all the left and LGBT headlines regarding these changes. The welfare of all female inmates, including those who identify as transmen, is completely disregarded and ignored.

 Today, the Trump Administration released changes to the federal Bureau of Prisons Transgender Offender Manual that undercuts constitutional protections and efforts in federal law – specifically the Prison Rape Enforcement Act (PREA) – to protect all prisoners from sexual assault and violence.

Richard Saenz, Lambda Legal Staff Attorney and Criminal Justice and Police Misconduct Strategist, releases the following statement:

“Once again, the Trump Administration is turning its back on those most vulnerable. It is well established that transgender prisoners – particularly transgender women housed in men’s facilities – suffer much greater rates of sexual abuse than other prison populations.

“A California study found that when transgender women are housed with men, they are 13 times more likely to be sexually assaulted than male prisoners in the same facilities.

“Conversely, it is increasingly common for correctional facilities to house transgender people consistent with their gender identity, and agencies have made these placements without experiencing any increase in abusive incidents or security risks.

“There is no justification for this policy shift; it is a deliberate recipe for violence against transgender people based in inexcusable prejudice.”

Truly remarkable.

Incidentally, that “13 times” figure you see bandied about originates from a 2007 California survey featuring a male transgender sample size of 39 individuals. THIRTY NINE individuals from ELEVEN YEARS AGO. “Transgender Sample -Not designed to generalize to larger populations” the study warns.

So Lambda Legal- the premiere authority and lobby group pushing for these policies- is citing completely worthless “data”. The National Center For Trans Equality uses the same study. So does the National Institute of Corrections [pdf]. But if you believe that figure you may as well also cite these, contained in the same study [PDF]: Men who are gay or bisexual suffer sexual assault in prison at 33 times the rate of heterosexuals. Small stature and mental illness are the greatest predictors of male prisoner vulnerability to sexual assault.

What is Lambda Legal doing about THAT? Not a damn thing. This isn’t about preventing sexual assaults of vulnerable males.

The male powers-that-be on the left keep pretending they’re trying to “solve” the issue of male violence: by subjecting women to more of it. It never works. It just harms women. (You know, women- the unmentionable half of the population not worthy of consideration except as a trash receptacle for men’s problems). Take a memo, fellas: if you think “MeToo” has been a “moment”, you haven’t seen the start of it.

Dominic Holden of Buzzfeed has published a blockbuster report outlining the split between top-funded LGBT lobbying groups over their ongoing battle to force women to give up areas segregated by sex for women’s privacy and protection from epidemic male sexual violence against women (changing rooms, showers, locker rooms, restrooms, hospital rooms, homeless shelters, lesbian services, domestic violence refuges, prison cells, etc) in order that men who desire to impose themselves on the women in those spaces would enjoy the right to do so.

Turns out the plan of convincing women and girls that male violation of female privacy is actually a Good Thing hasn’t panned out too well, and women still don’t want strange men exposing their dicks and they still don’t like strange males watching them as they wrestle out of a wet bathing suit in the locker room at the YMCA.

This, even though it’s been explained to them that biological sex doesn’t really exist and that the whole global male targeting of women thing isn’t even a thing. Even though they’ve been educated that women’s fear of creepy dudes doing god knows what fucked up thing is actually a kooky form of silly female hysteria and social panic. Even though they’ve been reassured that no man alive would ever shoulder the humiliation of throwing on a wig just to have a free ticket to get their freak on at women’s expense. Even though it’s been explained to them that some men are really scared of the other men in sex segregated spaces and/or that it really, really hurts men’s feelings that women have a boundary against male entry to spaces where they are pulling their pants down or inserting a tampon. Even though they’ve been let to know that any male who believes himself to have “female feelings” is incapable of, through commission or act of omission, taking any action which is harmful towards a female person and no such act has ever been recorded in the history of humankind. Even though they’ve been told that letting guys expose themselves and allowing them to gaze upon women undressing may be part of their prescribed psychiatric treatment plan for a ‘Gender Identity’ that all women must sacrifice their comfort and privacy in order to participate in implementing. Unless they are heartless, cruel, hysterical, prudish, bigoted, crazy, awful, nasty women. Of course. Women who want countless men to suffer gruesome violent deaths by murder and suicide all caused by their selfishness.

Anyway, the LGBT campaign against women’s right to privacy and safety, funded by millions (billions?) hasn’t worked out after a decade or so. To paraphrase Barney Frank’s cogent observation at the time of the ENDA debacle: women don’t want you to inflict your dicks on them. Crazy, huh guys?

Holden’s Buzzfeed piece exposes the breakdown of the alliance of the former Gay Rights Movement and the Transgender Penis Rights Movement and their frustration over their dual inability to coerce consent from unwilling women.

Tough break guys. Who could have seen it coming.

From NBC 5 Dallas-Fort Worth: “A transgender woman who was ticketed for using the women’s restroom at a Dallas hospital says her status as a convicted sex offender should not play a role in the citation.”

Last Wednesday, 56 year old Paul Ray Witherspoon frightened a female hospital patient while using the women and girl’s restroom at Dallas Parkland Hospital while wearing a bulky ankle tracking device used for high risk parolees. The woman notified the police, who arrived at the scene and questioned the parolee, who offered that he is a serial child sexual predator now on monitored GPS tracking for his parole.

More from NBC 5:  “Witherspoon said on Wednesday that her criminal past is no secret.

“It happened over 22 years ago, and I’m human,” she said. “I made a mistake.”

According to the Texas Public Sex Offender Registry, Witherspoon was convicted in 1990 for sexual assault of a child and indecency with a child involving sexual contact. Both victims were teenage girls.

“It’s a tragic mistake, I admit, but I’m getting therapy for it and trying to go on with my life,” Witherspoon said.

“I have to register as a sex offender the rest of my life, and I have to live with that,” she said.

But according to the Texas Attorney General website, Witherspoon was arrested again in 2011 for for a parole violation for sending nude pictures of himself through the Internet.

Last Wednesday, when the officer asked Witherspoon, whose driver’s license records him as male, why he was using the female restroom Witherspoon informed the officer that he had recently become transgendered, and was therefore permitted to access private women and girls facilities due to his internal feeling of “gender identity”. The officer cited him for disorderly conduct, a class C misdemeanor. The woman who reported him to police has not yet released more information about the incident, citing the fact that she is “afraid“.

Paul Ray Witherspoon, calling himself “Paula”, claimed he was at the hospital accompanying his “husband” Billy Lorentz to an appointment. However since Texas resident Witherspoon is legally male as is his partner, and Texas does not recognize same-sex marriage that claim is called into question. Lorentz is listed as Witherspoon’s employer on his TX sex offender record.

The DallasVoice reports that Witherspoon said he offered to show the investigating officer a “carry letter” from his psychiatrist stating that he is transgender, and that the officer declined. A photo of the letter is reprinted here.  But as you can see, the letter was written two days AFTER Witherspoon was cited.

Lambda Legal representative Ken Upton claims that pedophilic male serial sex offenders should be allowed to access private women and girls facilties regardless of legal gender status as long as the men are “using the bathroom in a way that is consistent with the gender that they live in day in and day out”. Upton did not qualify what objective measure would record the internal feelings or behaviors of convicted predators or what would indicate that predators “live in a gender” day in and day out.

Lambda Legal’s Upton went on to suggest that males who groom or wear clothing in ways that may be seen as nontraditionally masculine may actually be considered “disruptive” or even qualify as “disorderly conduct” for using male facilities designed for their actual sex :

“If you want to talk about disorderly conduct, you have to wonder which would cause more of a disruption — her going into the women’s restroom and using it with other women or going into the men’s restroom dressed the way she was, whether that would have been any better,” he said.”

As a butch lesbian, I find it shocking and inappropriate that an LGBT advocacy group like Lambda Legal suggests that legally male serially convicted child sexual predators should be given free reign to enter private, protected spaces for women and girls on the basis of those male’s subjective claims of feeling an internal “gender identity”. Further, the assertion by Lambda Legal that males who do not adhere to cultural standards of masculinity would be considered “disruptive” in ANY male setting whatsoever is a claim that every gay and lesbian person should find deeply offensive.

Reporter Janet St James at Channel 4 KMOV St. Louis  spoke to the female complaintant who called the cops on Witherspoon (she  has thus far declined to issue a public statement) and states the woman is ‘still very upset about it”.
